DATATEAM CORPORATE WEBSITE TERMS OF USE

PLEASE READ ALL OF THE FOLLOWING TERMS CAREFULLY BEFORE USING OUR WEBSITE.

By visiting and/or using our website, you represent and warrant that you have the legal capacity, authority, and competence to enter into a contract in accordance with applicable laws and/or as an authorized representative of a legal entity; that you have read, understood, and agreed to be bound by these Terms of Use; and that you accept all conditions set forth herein. If any of the terms below are not acceptable to you, please do not use our website. Otherwise, Datateam shall not accept any liability arising from unauthorized or legally incompetent use of the website.

1. Parties

These Terms of Use are entered into between Datateam Bilgi Teknolojileri Anonim Şirketi, registered at Cyberpark Cyber Plaza, Üniversiteler, Bilkent Blv. A Block No: 502, 06800 Çankaya/Ankara (“Datateam” or the “Company”), and the party who uses and benefits from the website created by the Company at https://datateam.com.tr/ https://datateam.com.tr/ (the “Site”), hereinafter referred to as the “user” or “customer.” These Terms govern the conditions of access to and use of the Site and set forth the rights and obligations of the parties. Datateam and the User may collectively be referred to as the “Parties” and individually as a “Party.”

2. Purpose

The Site has been created to introduce Datateam’s products and solutions and to provide visitors with information about developments, projects, and announcements in the fields of information technologies and data analytics.

By visiting and/or using the Site, users are deemed to have undertaken to comply with these Terms of Use from the moment they access the Site.

3. Use of Services, Obligations, and Undertakings

The services offered on the Site are prepared for customers and potential customers.

The contact information provided by the user to Datateam must be accurate and belong to the user. Any liability arising from the use of incorrect or third-party information shall rest solely with the user.

All transactions, notifications, and/or correspondence carried out by Datateam shall be based on the information provided by the user.

The Company assumes that all information provided is accurate and acts accordingly. The Company shall not be held liable for any errors arising from inaccurate, incorrect, or misleading information declared by the user.

In the event that the user violates the obligations accepted under these Terms of Use and/or engages in unlawful sharing on the Site, the user acknowledges that Datateam has the right to take necessary measures, may prevent the user from accessing the Site in the future, and/or may initiate legal proceedings against the user.

The user may not engage in false or misleading conduct (e.g., fraudulent requests for money or impersonation).

The user agrees and undertakes not to reproduce, copy, distribute, process, or otherwise use any elements on the Site, including but not limited to images, texts, visual and audio materials, files, databases, products, solutions, and software, nor to engage in any acts that may constitute unfair competition, directly or indirectly.

The use of the Site interface provided by Datateam for purposes other than obtaining information about Datateam products and innovations, e-learning, and new projects; the partial or complete copying of advertisements, customer information, designs, codes, software, or database content; unlawful access thereto; or the direct or indirect use, publication, compilation, processing, modification, transfer to other databases, or enabling unlawful third-party access to such content shall entitle Datateam to claim compensation and pursue all legal remedies for any damages incurred.

Any attempt to use the Site or any part thereof for the purpose of disruption, modification, or reverse engineering; to interfere with or disrupt the Site’s communication or technical systems; to access the Site through automated programs, robots, spiders, web crawlers, data mining, data scraping tools, or similar software or processes; to access other users’ data or software without authorization; or to use the Site or its content in violation of these Terms is unlawful, and Datateam reserves the right to claim compensation and pursue legal remedies for any resulting damages.

Users are strictly prohibited from engaging in any activity that may threaten the security of the Site, disrupt the operation of the Site’s software, prevent other users from benefiting from the Site, impose disproportionate loads on the Site, gain unauthorized access to published or entered information, endanger the overall security of the Site, damage the Site or other users, interfere with software or server operations, manipulate software code, perform reverse engineering, conduct attacks, or attempt unauthorized server access.

The user may not engage in behavior on the Platform that is harmful to others (e.g., viruses, stalking, harassment, hate speech, or advocacy of violence).

In the event of a breach of these Terms by the user, a complaint by another user, a notification of intellectual property infringement, or a request for content removal, Datateam may claim compensation from the user for all damages incurred.

4. Disclaimer and Limitation of Liability

To the maximum extent permitted by law and unless Datateam has entered into a separate written agreement replacing these Terms of Use, Datateam shall not be liable to users for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, reputation, profit, or revenue (including, without limitation, offensive or degrading statements, service interruptions or losses, or the use or modification of personal information or content). Datateam shall not be liable for any direct or indirect damages, including loss of profit, goodwill, or reputation, arising from the use of the Site or interruption of access to the Site.

5. Intellectual Property

All rights, including intellectual and/or industrial property rights, to the software, visuals, designs, texts, logos, graphics, trademarks, and all other elements on the Site belong to Datateam. Copying, distributing, processing, or otherwise using any content on the Platform beyond its intended use is strictly prohibited.

The user accepts, declares, and undertakes that they shall be solely responsible for any damages incurred by other users, third parties, and/or Datateam arising from acts constituting intellectual and/or industrial property rights infringement.

6. Termination

If any provision of these Terms of Use is deemed unsuitable by the user, the user may discontinue using the Site at any time. Datateam may, without prior notice, modify, suspend, or terminate access to some or all services or the Site. The user acknowledges that they shall not claim any damages arising therefrom. Where legally required or deemed necessary, Datateam may share information declared by the user through various forms with public or private institutions or third parties specified under personal data protection regulations, in accordance with the purposes stated in the Privacy Notice. The user agrees not to claim any compensation from Datateam on any grounds.

7. Disputes

Any disputes arising between the Parties shall first be resolved amicably. In the event that an amicable resolution cannot be reached, Ankara Courts and Enforcement Offices shall have jurisdiction. Upon a duly made request from judicial or investigative authorities, Datateam may share the requested information, documents, and records with such authorities.

8. Force Majeure

In all events legally recognized as force majeure, Datateam shall not be liable for any compensation arising from delayed, incomplete, or non-performance. Events beyond Datateam’s reasonable control, including but not limited to natural disasters, strikes, lockouts, epidemics, war, partial or general mobilization, decisions or actions of public authorities delaying or preventing performance, adverse weather conditions, infrastructure or internet failures, system maintenance or upgrades, power outages, and similar circumstances shall be deemed force majeure.

9. Effectiveness and Acceptance

These Terms of Use, including any amendments and/or updates, shall be deemed accepted by the User from the moment the User begins using the Site and shall enter into force as of the date they are published on the Site.
